Terms of service

The agreement that governs your use of nomadall.

These terms govern your access to and use of nomadall ("we", "us", "our"). They take effect on the date shown above. By creating an account or using the service you agree to them. If you are accepting on behalf of a company or organization, you confirm you have the authority to bind it.

1. Agreement and acceptance

This is the current, dated version of our terms. You accept them when you sign up or use the service, and you accept updated versions when we ask you to (see "Changes to these terms"). If you're accepting for an organization, "you" means that organization.

2. The service

nomadall is finished business software, one product built for each kind of business. We work to keep it available and reliable, but we don't promise it will never go down. We provide it on a commercially reasonable basis, without a specific uptime guarantee unless we agree one with you in writing.

3. Your account

Keep your account information accurate and your login details private. You're responsible for what happens under your account and for the people you invite into it. Tell us promptly if you think someone has gained access without permission.

4. Acceptable use

Don't use nomadall to break the law, harm others, or infringe anyone's rights. Don't upload malware, scrape or overload the service, or try to reverse engineer it. Don't resell access without our consent. If you send messages, texts, or email through the platform, follow the laws that apply to them, including getting the consent you need and honoring opt-outs.

5. AI features

AI features can make mistakes. Review AI output before you rely on it for anything that matters, such as money, legal, contractual, or hiring decisions. You're responsible for the actions you take based on what AI suggests. AI usage may be metered and counted toward your plan. See our AI page for how it works and where a human stays in charge.

6. Your data and ownership

The data you put into nomadall stays yours. You give us permission to process it so we can run the service for you, as described in our Privacy Policy. You're responsible for the data you enter and for having the right to use it.

7. Fees and billing

Paid plans are billed as described on our pricing page, and some parts are usage-based (like your messaging balance and AI usage). Fees are generally billed in advance and non-refundable except where the law requires otherwise. See the pricing page for current plan details.

8. Third-party services

Some features rely on other companies, such as Stripe for payments, Twilio for texts and calls, and others. When you use those features, their terms also apply. We're not responsible for services we don't control.

9. Disclaimers

The service is provided "AS IS" and "AS AVAILABLE", without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We don't warrant that the service will be uninterrupted, error-free, or fit for a particular purpose.

10. Limitation of liability

To the extent permitted by law, we're not liable for indirect, incidental, or consequential damages, and our total liability for any claim is capped at the fees you paid us in the twelve months before the claim arose.

11. Indemnification

You agree to cover our reasonable losses if they come from your misuse of the service, the data or content you put in, or your breach of these terms.

12. Resolving disputes

Let's try to work it out first: email legal@nomadall.com and we'll try to resolve it informally within 30 days. If that doesn't settle it, disputes are handled by binding individual arbitration rather than in court, on an individual basis (no class actions). You can opt out of arbitration by emailing us within 30 days of first accepting these terms, and either of us can still bring a qualifying claim in small-claims court.

13. Termination

Either of us can end this agreement. When it ends, you'll have a reasonable window to export your data before we delete it. See the data deletion page for how that works.

14. Governing law

These terms are governed by the laws of the State of California, without regard to conflict-of-laws rules. Any dispute that isn't arbitrated will be handled in the courts located in California.

15. Changes to these terms

We may update these terms. When a change is material, we'll ask you to review and agree again before you keep using nomadall. The date at the top shows the current version.
